State commission tables request for ABC store
An ABC store proposed for Upward Road won’t open this fall, as the N.C. Alcoholic Beverage Control Commission voted unanimously Wednesday to table a request for the store from the Hendersonville ABC Board. Incoming Hendersonville ABC Board Chairman Charles Byrd asked the three-member state commission to table the vote after ABC Commission Administrator Mike Herring recommended against approving the proposed site at 755B Upward Road, according to a news release. Herring cited the fact the location is one-and-a-half miles inside the limits of Henderson County, which is dry and has not had a vote on the issue since the 1950s.
The state commission also took into consideration opposition from county commissioners, who voiced their disapproval of the proposed store at their meeting last week.
“I understand the business rationale for the store. But the statute tells us to consider how the community has voted,” ABC Chairman Jon Williams said at the commission’s monthly meeting. “This store would be located in the middle of a community that has chosen to be dry, and I have concerns about that.”
Williams asked the Hendersonville ABC Board whether it preferred to have the state commission vote on the request or to defer the decision until the local board asks to be heard again.
Local ABC boards have the authority to operate one store, while additional stores require the approval of the state commission. Hendersonville currently has two ABC stores, one on South Church Street and the other on Thompson Street.
The half-acre, vacant site on Upward Road is 1.45 miles outside the city of Hendersonville limits, but was satellite annexed by the city last month at the request of property owner Mountain Inn & Suites for the purpose of building an ABC store.
County Commissioner Larry Young expressed opposition to the proposed store at last week’s commissioners meeting, saying the location is less than one mile from East Henderson High and less than a half-mile from Upward Elementary. “I just don’t think it’s an appropriate place for an ABC store,” he said.
Criteria used by the state commission in considering a new store include whether the health, safety or general welfare of the community will be adversely affected; the store’s proximity to schools and churches; and opposition from the community.
